Ok, first of all, ignore all the advice you get about inter-cultural relationships not working. I am non-Indian and I married an Indian man. We have been married for over 7 years, have two children and now live in India.
Divorce can be very complicated in India and your BF needs to get a good lawyer working on it ASAP. The problem is in some communities women still don't want to get divorced and they can drag it out and fight it for a VERY long time. Courts here can also deny a divorce! THey can force people to stay married!
You cannot marry him unless he is divorced. Sorry. If he does get divorced then getting married in India is no big deal. There are different residency requirements depending what type of marriage your are registering. In India marriages are registered under different laws depending upon the religion of the couple. A couple who is of different religions generally gets married under the secular law and that requires a 30 day residency in India.
Working in India is also not a problem. Just make sure you enter on the right visa so you don't run into problems down the road. India is pretty strict with its visa requirements and you don't want to get into trouble.

You know every thing about divorce & marriage in India as I have been telling you, but now you have come out with this fact that you want to marry him or stay with him in India, knowing this fact he is married & his divorce can take 2-3 years if ever thing goes smoothly. Yes you cannot legally marry him, neither under the Foreign Marriage Act, 1969 which is applicable to Indian citizen to marry a foreigner where his being unmarried or divorced or widower is the very first condition. But now how you can marry him otherwise? Yes you can do so which I will not tell here but send you details on your email. Yes you can get job in India if you are qualified for any job according to Indian standard, even you can get job in any MNCs here.

I think you need to research things very carefully. The culture is the main thing. How to act and not offend or embarrass your new family, even if accidentally. It's hard to fix. Your status as a human being will change, can you cope with that? If you change your mind and can't live there, what are the options? If you are severely unhappy, will you be able to go home? Will your family have any say in your life, or will it all come down to his family and their wishes? Will you be allowed to culturally educate your children on German issues, or will they have to be totally Indian? Will you be allowed to work? Can you cope with a large, extended family, in which there is a defined hierarchy? Can you be the perfect wife/mother/sister? Can you deal with your husband having total freedom, whilst you have to answer for every thought and action? I wish you well, and much happiness. However, it is not just where you are going to live, but HOW, you are going to be required to live. The very person you are will have to change. It is true of any cultural change, not just Indian. I'm from Europe and have Indian relatives. They are very westernized, but they themselves point out these differences in culture. The status of females is just not the same. A person from US can marry an Indian woman, if he is single in status or a divorcee. Even if he is not living with his wife for a long time, that does'nt mean that he is legally separated from his wife. He can very well apply for a divorce from his wife where their marriage was solemnised. If he is having any children from that wedlock he has to maintain them and whatever he is earning fifty percent of that will go for the maintenance of his wife and children. Fifty percent of his property also he has to part with if he is going for a divorce. If they are married in India and she is also an Indian then they can apply for a mutual divorce in Indian Court. If his wife is also an American and their marriage was performed in US, then an Indain court does not have jurisdiction over this matter. If he is ready to part with his salary and property then he can consult his Attorney for a mutual divorce and if the man does not want to continue his life with a partner whom he does'nt like, no court can compel him. He will definitely get a divorce from any court.

why u r trying to make your life complicated? firstly, marry from your own country. its tough to get along even marrying in inter-community level. marrying a foreigner is not a good decision because the cultures are quite different. neither of the 2can get along with easily. marriage is not between 2persons only rather it invol;ves 2 cultures and hundreds of people. dont' put everybody in trouble.
secondly, he is already married. why you are trying to poke your nose into other wifes affairs. he give divorce or not its their problem. you have no feeling for others. lots bachelor guy will be out there in case you need some nice **** session. leave the couple where they are. dont' involve india in your silly act. india is not a fertile ******* ground. you sud be ashamed of asking legality of your marriage in india. shameless fellow!!

actually there are no rules in India and thing that wins and lasts is a seen as a rule. But still to fight it out technically and legaly we have law and If you are seriuous you should hire an advocate. I know one who makes money by doing just that. and a good one. Ya its hard to get divorce very hard and expensive

U cant get married to him unless he gets a divorse. If it really means that much to u, depending on where u are in india, u could get a job easily.If ure in Mumbai the easiest job u could get is as an American accent trainer in any of the call centers they pay well according to indian standards .
