My friend had his drivers license suspended for owing child support in California. He wants to move to Virginia and was wondering if he would be able to get a license when he got here. He is unsure if the Cali suspension will carry over to Virginia. So I am setting out to find out if when he does move here, if he will be able to get a drivers license in Virginia with a suspended California license.

Yes. The computer system that links states and their Department of Motor Vehicles will tell another state that the license is suspended. The law is called the Driver's License Compact. With a suspended license, another state will not issue another license during the term of the suspension. If the suspension is by court order, no other state will go over the head of the other state's courts.

Since he is in California, this is what the California Vehicle Code Section 15024 states about the multi-state compact (agreement) between the states:

"Upon an application for a license to drive, the licensing authority in a party state shall ascertain whether the applicant has ever held , or is the holder of a license to drive issued by any other party state. The licensing authority in the state where application is made shall not issue a license to drive to the applicant if: (1) the applicant has held such a license, but the license has been suspended by reason, in whole or in part, of a violation, and if such suspension period has not been terminated. . . ."

He will have to get a lawyer and take care of the child support, and get the suspension lifted by the court that issued the order. Then he can apply in his current state, or another state, if he moves.

Suspended license is a suspended license.. all other states will honour other states decisions... You arent likely gonna get a license in any state until that suspension is gone.. CA isnt gonna give you a license with a suspension on your record.. you kidding me.. this state has actually made it harder to get a license in recent years... You should have paid the tickets.. they were both pretty minor infractions... And seeing who you work for you should have known better (I'm suprised they havent fired you yet to tell the truth)

Most states now cooperate with each other for DUI offenses, etc., so I woldn't be surprised if they cooperate with DL's. There may be question on the DL application asking if you have another state's license or if that license has been suspended or revoked. Beyond that, your 'friend' should make good on the child support. The DA's offices here will find him and he'll do time if he's skipped and can't pay. In essence, he's defrauding the state.

All the states have DMV reciprocity. So if he shows up at the department office in Virginia and requests the new license, VA will know in an instant that he's under suspension.

Yes it will carry over. The state of Virginia can look this information up in the computer system with his SSN. Some states issue driver's licenses based on your SSN. California assigns you a seperate license number starting with a letter of the alphabet.

He also has to notify his ex-wife or ex-girlfriend of his intentions to move out of state. If he moves without notifying her by certified mail, she can & should file an injuction to have him arrested for skipping the state to avoid payments on court-ordered child support. My son's father moved 2 years ago without notifying me. I found out after SSI contacted him about not protecting his son on the SSI claim. I was pressing fraud charges & they were dropped, pending he'd add our son to the claim. He's now serving 4 years in a Washington state prison, but probably will only serve 1-2, with time off for good behavior for failure to properly notify the custodial parent of his intention & subsequent move out of state. I wouldn't have objected to the move at all, had he told me. Since he didn't, I pushed for the jail time on the moving. He figured since we hadn't gotten married, he didn't have to bother (we were engaged to be married when I got pregnant & had my son).

Be careful who you're friends with, my dear. Men that have their license suspended for non child support payments are bad news. It's usually a way to get back at the ex for one reason or another & that trickles down to the child(ren). If you think he wouldn't do that to you, think again. Start rethinking your friendship with this man & make some drastic changes to get him out of your life.

No. He will be unable to get a license in any other state while he has an active suspension.

Yes states have to honor the court rulings of all other states.

yes it can affect the chances of obtaining a license in another state, bc they will know about the supension

Yes, it's nation wide! He should pay his child support. I raised my daughter alone and I had to work to jobs to provide a decent living for her because my x- husband was a dead beat dad. Who suffers? The child! She didn't have enough of time with me and her father is still an *** , but she put herself through college, and I thank God I tried to show her how important it is to get a good education and be able to support herself and a child if she ever gets a divorce.
