I agree with you to a degree. I think that if someone has committed a crime that is considered to be "capital", they should be sentenced to a punishment that will cause them some of the pain and anguish they've caused others with ultimate death.
I don't know that it's proper to deem it "cruel & unusual", but I definitely think that a lower form of "torture" should be inflicted on others. If they've committed sexual assault or rape, by all means, cut their genitals off. If they commit severe damage with arson, hold their hands to the flame, literally. I think that people should pay for what they've done rather than get a slap on the hand.
For those on death row, they live a pretty nice life for prison. They generally don't share a cell with anyone, they eat well, they exercise, they get cable tv,.. the list goes on. Is that the treatment we give to those who have murdered or tortured for their own enjoyment?
I hear you man, and I'm with you on it. The system has flaws and all we can do is watch the other countries get their message across with a more suitable punishment while our country makes sure that our inmates don't miss their favorite shows.

I agree. How is putting someone out of their own miserable existence punishing them? It doesn't, it punishes their families who are not repsonsible for the criminal's wrongdoings. I think cruel punishment would serve a much better purpose, and it would act as a much stronger deterrent.

Depends on the situation , the crime and what 12 people on a jury say. If the person is absolute future threat to society, then do the same as you would to a rabid dog attacking your child, stop the dog forever before it is done to some one else. I am for the death penalty , in some cases.

Execution is not designed to solve any problem. It is designed to make the victims, the victims families and society as a whole feel like we care.
And why is everyone so bent on people learning their lesson are we a society of school teachers.

One good arguement for executions, no repeat offenders.
Personally, I think executions should be made public. Schools should have field trips to watch people being executed. They would realize that there are consequences for their actions.

There are arguments each way. On the one hand, there's probably nothing quite so cathartic as a good public hanging. On the other, rotting in some hell-hole is probably worse than being hung. It depends on whether you want to please the crowd or torture the criminal.
