So, I woke up this morning with the sound of kids laughing and the sound of rocks being thrown. I heard the voices and they were the kids i knew down the street. I could barley see two that I knew.
Anyways, I thought I should let them play and have fun, no harm was being done, right? So Later in the day, I was going out to get the mail. I see all these rocks in the street, my garbage can lid on my drive way, rocks on our car and all over the driveway, oil on the outside of my gate, spilled on the drive way, and on the front of my garage door. The car paint was chipped and there were chips on my bedroom window. I talked to their parents and they said their kid wasnt out. And once I thought about it, the kid I saw was shorter than the boy I thought did it. They said the other kid that was out that I knew was known to throw rocks, and we know the mom of the kid wasn't very compliant . For ex: she wouldnt talk.
By law, what can I do and how can I force the mom to talk?

Sorry, I know for sure one of the kids did it, and I know who it looks like, and the parents are not good parents at all.

The thing that you need is proof. Beyond a reasonable doubt is the What you can consider is to observe from one of your windows and take pictures of the rock throwers, or at least be able to make a positive id if you need to call the police again. As
a matter of law, the only way that the mother could be compelled to say anything would be under oath on the witness stand. Even then, if she chose to protect her child she could simply refuse to answer any questions. She could be held in civil contempt if she chose that route, but it is known to happen. Take it from me, you will do far better to gather proof of who threw the rocks, because that way the guilty parties will be punished.

Wow, you do have a problem. First of all, if you cannot identify the boys, you will have a hard time proving who did it. How are these people as neighbors? This is one of the first problems I have found today. People don't take the time to get to know each other. I believe that if you had a relationship of some kind with these families, they would be hard pressed 'not' to come to the truth about the damage done to your property. Legally, you don't have a case. The only thing you can do is get your insurance involved, make sure your vehicle is covered (car port, garage) and keep an eye on your property. Remove any rocks that might be in your area, or at least make them inaccessible. I have seen court cases on television and have learned that it is difficult to prove unless someone fesses up. I doubt if these people will. But if they are any kind of parents, I'll bet they have admonished their young about their behavior. If in doubt, call the legal aid just to get your questions answered. Unfortunately you have no proof of which kids threw the rocks, etc. You would have to get the police to get one of the kids to admit that they did throw the rocks and caused the damage. Not a very good chance.

I would recommend that you install motion detector lighting to deter this again.

P.S. Even if the mother talked, it would be hear-say .. you have to have an admission the person who caused the damage.

Sorry to hear about the vandalism. Sadly, kids just don't understand people work hard for the things they have. I would set up a video camera, take pitcures, & report them to the police. If you don't say anything, their just going to keep on doing it because they know they can & will get away with it! Do something ASAP. Those little brats shouldn't get away with breaking the law! You should report the incident to the police and let them investigate. Next time you hear the kids out call the police and explain to them to come with out using their sirens. Maybe they will catch them in the act of vandalizing some ones property.

If you know who did it (saw them and can identify them), sue them for the damages in small claims court. You don't have to have proof (it helps, but isn't absolutely necessary). The judge just has to decide who he believes. File a police report, too.
