sure, if everyone pumping toxins into the atmosphere should be prosecuted along with her!
if you even start something like that, it would never end, because everything is potentially harmful to a fetus...EVERYTHING(including emissions from burning fossil fuels, and mercury emissions). luckily humans are fairly resilient, compared to most other organisms.

I don't think women in general should not be prosecuted for smoking cigarettes or having one or two glasses of alcohol.

Am speaking from experience I have two beautiful children that I smoked cigarettes and stop smoking pot when I found out that I was pregnant . I was told by my OBYGN to have a drink once a month to help with my blood flow. The state still thought that I was in the wrong for having one drink and smoking my cigarettes and being around pot smoke.

It comes down to how pick the state and doctors want to be. But in my eyes, I could see a female being prosecuted if they come back positive for a hard drugs (not pot) or the baby was born with alcohol in it system. Cigarettes, what are they going to charge you with?

No. There is not yet any law that would apply that the courts would recognize. Prosecuting a woman for this behavior would open the door to a reversal of Roe V. Wade, and nobody wants to touch that one, apparently.

Regarding drug use, she should be exposed to the same criminal liabilities anybody that uses illegal drugs incurrs.

whats funny is that when its in this situation its a infant and the mother should be prosecuted but when its abortion its a fetus and mothers choice.
Isnt this just another form of mothers choice? I mean if she wants to end up with a mentally retarded child is that her choice?

Yes.

Because when they smoke, drink and do drugs they are doing all three for 2 people, not just themselves.

Have you ever seen a crack baby?

How sad that a woman would do that to her own baby!

Abortion would have been a much better decision.

A) Should be prosecuted for endangering a minor; and

B) sterilization...because someone who cares so little about anyone's life should not be able to bring a baby into this world for whom she will have no interest in caring for.

No, they're the ones making that decision.....it's a shame but there would be no right to prosecute, in my opinion.

maybe, but it wouldn't do any good. then the state would just have to take care of them. taxes would go up to cover the cost.
