My husband makes all the money, I am a homemaker. I don't have much money saved on my own, so can someone please explain the process? Thanks....

Are you the first to be filing for divorce or is he? If he is then sit back and let his attorney do all the work at his expense. They will send you a copy of his demands and you can agree on all or whatever one you want to, send it back. This goes on to the point of total agreement then goes to court as settled out of court. If youre filing then the above is going to be at your expense. Now you can hire a Paralegal and save thousands of dollars. The Paralegal does the attorneys paperwork anyway. Dont know for sure for NY but most states wont let the Paralegal take the case into an actual courtroom. Sometimes couples get together with a Paralegal and sit down and work out all the details in one sitting as it saves time. Most without children do it this way. The Paralegal will do all your legal paperwork and will file it if you want. If your husband files, you can also contact a Paralegal for advice and still save a bundle. Not as bad as it sounds, just as long as neither spouse contests the divorce but then there are ways around that too but usually costs a little more and takes more time. Good luck

Call around as some attorneys do not have a consultation fee. However, they all want a retaining fee and it can be expensive around $2,500 on the low side. Fees can be negotiated as to how much and when to get paid but they all want their money for the work they will have to do.

Now, if you have no funds, you have 2 choices. You can either ask them if they can do the work Pro bono (for free). Some attorneys will do some cases for free. Or you can check to see if they have free legal aid on the county you live in. Some other counties will offer a do-it-yourself divorce. I do not recommend these unless you know what you are doing. The laws are different from country to country. But my best advice to you is, if you get someone to take on your case, get it in writing what percentage they are going to ask for when it has been all settled. I live in Australia. When I asked how much would I be looking at I was told roughly $15,000 over an 18 month period. My case was settled out of court in three months and I was charged
$17,500 for it, but because I didn't have any proof of what I had been told at the beginning, there wasn't anything I could do about it. So get everything in writing from them.

You can go to your city court house and ask them where you can get free legal advice. They should have a list of places to go for people with low to no income.
