today I got into a fender-bender...I was in the middle lane and had to turn left...checked my blond spot and the rear view mirror...saw a car in the rear view, but was far behind..turned the indicator ON and started entering the left lane...the car behind me didn't stop and dented mine just below the tank..the driver didn't accept his fault and further more asked me to pay for the damage....we called up police, but they said they won't come as it was a minor accident and nobody got hurt....we ended up not going to the poice (cuz of the fear of rising insurance) but we didn't get to a conclusion...he said he will give me a call after enquiring how much does it cost to get it fixed....I believe its not my fault and I got a dent, he just got scratches on front right of his car. He kept on saying that it was a solid line dividing the lanes so I am not allowed to change the lane and it was his right of way. I dont agree, he was probably speeding and he didnt slow down at all.

what is your question?

you say you looked in your mirror and the guy was "far behind." obviously if he was speeding, you would have noticed it in your mirror. you shouldnt have cut him off and just waited for him to past and go into the lane after he was in front of you.

If there were solid lines No you were not suppose to switch lanes. If there were not though you have a chance to fight it before you left the seen you should have gotten anyone's information who may have seen the accident. I would say check the lines tomorrow and see what type they were then make a sign and leave it at he corner if you did not get anyone's information telling the that if they witnessed the accident to give you a call just in case it goes to court between the two insurance companies. The worse that will happen is 1. he has No insurace, or 2. your insurance will go up Good luck and do not forget to try to get witnesses.

Without a police report, it is your word against his, your idea of what happened against his idea. It is possible that you both will just have to repair your own vehicle and move on. The one thing you have going for you is that he hit the backside of your car (rear-ended you). Unless he can show that you were driving erractically or illegally (crossing a solid white line), he is probably at fault. Whenever there is damage to your car in an accident that you believe is the other driver's fault, always call the police to get a report.

First of all, how can it be his right of way if he is behind you and you are going into the left lane? Right of way to what?

I finally found out that crossing a solid line is not illegal only not recommended. It is only illegal if there are TWO solid lines.

Even if you shouldn't cross a solid line, he would still be responsible for driving too close to be able to stop.

HE hit YOU! You did not cause him to hit you. It is a very rare circumstance for the person being hit to somehow be responsible for being hit from behind.

Police should show up to any accident causing damage. Damage can be caused even it is unseen. I would recommend that if he gives you any harassment that you should both go to the police department - they should have record of your calling - and have fault settled there. Best bet is always to keep it 'legal'. If he insists you are at fault then he needs to prove it.

If fault is his, as it seems to be, HIS insurance would go up, not yours. Also, HIS insurance will pay your deductible and costs just to fix your dent, lol.

I don't believe you for several reasons. First, you said the police refused to respond to the scene of an collision. Second, you said your damage was 'just below the tank'. I have yet to see a car with any tank positioned where it was possible to be hit 'just below the tank'. That said, based on your account, you cut the other car off. It is your fault.

Well just because u turned on your indicator doesn't mean you have the right to get over!!! as some people mines are not always on lights, and 9 times out of 10 he won't call u any way! so i think u r on your own as for as the payment of getting u r car fixed!! good luck to u!!!!!

If he ran into you HE IS AT FAULT. If he continues to make an issue out of it, contact your insurance company. Trust me, it is worth going through that before paying for some douchebags damages that aren't your fault.

you know what if he says that you have to pay for his car and he doesn't want to pay for your car repairs then you tell him no and say to him to repair his own car and you repair yours.
