there was no solisitor present and i was drugged was on tablets for depression and other stuff so thefore i wasnt in the right state of mind

You may be able to get her back, but you should ask yourself if you should.

Are you still depressed? Are you taking medication for it? If you're depressed and not taking medication that works, you are not in any shape to raise a child.

If your sister has been providing a good home for your daughter for several months or longer, you are not doing what is in your daughter's best interest by trying to remove her from that home. Your daughter needs stability and parents who are there for her and involved in her life. Are you capable of providing that now?

And even if you are, you will be disrupting her life in an enormous way that will have long-term repercussions. If you want to be a good mother and do what is absolutely in the best interest of your child, you will put HER emotional stability first and, if she is now thinking of your sister as her mother, leave her right where she is.
Your sister should allow you to visit her and if your sister is a decent person, she will let the two of you become close. But it is not worth destroying that child's life to fight over her. You are only really her mother if you put her interests ahead of your own.
If you can't do that, you should not have her back.

I hope you and your sister can work things out together and do what is best for your little girl.

it really depends on why she took her were you unfit did she prove it did she get you on abandonment charges there is really alot to question you need to get an attorney!!!
