File as you would normally and send the divorce papers along with the return. You'll receive notification from the IRS with the duplicate claim. Your ex-spouse will have to prove he/she is entitled to make the claim.

If he already claimed him this year before you, then if I were you, I would also claim the child and when the IRS sees the matching social securities numbers, they will send you both paperwork and you will be able to prove that you were suppose to claim the child and he will have to pay it back. Or you could take him to court and get the money if he hasn't already spent it.

Both of you will get letters from the IRS stating 2 have claimed him. YOU are the legal guardian so be sure to definately cle=aim him. The irs.gov website has an 800# that you can call and nail his *** before they send him a check.

The only one who can claim him is the one who pays the most for the kid.

Example: Daycare costs, Private School, doctors' bills, grocery receipts, clothing receipts, etc.

Bring this to the attention of your CPA and lawyer.

make sure you send a copy of the page (in your divorce papers )with your taxes .thats what i had to do .if you sent them already they may ask for it later

You can get a form from HR BLOCK or the IRS called an 'injured spouse' form.Fill that out and send it in.
