good point. Usu., the Constitution is thought of the prevent the government from doing something, not to make them do something. But as you point out, there are exceptions (the Sixth Amendment guarantees alleged criminals the right to counsel). Once critical point: What if I were to say that couldn't be happy unless I get a house on the beach? Does the government then have to provide me with that? If no, why not? There would be problems limiting what the government has to provide if it must provide you with the means to happiness. In fact, the Constitution doesn't gurarantee happiness. That's in the Declaration of Independence. The Constitution says: life, liberty, and property cannot be deprived without due process of law.

First, the pursuit of happiness is in no way guaranteed by the Constitution. Second, you are guaranteed due process of law by the Fifth Amendment. Finally, the Constitution does not guarantee free health care for everyone. However, it is well within Congress' power to authorize a universal health care system. This is because health care can easily be described as commerce (under its current system). Congress has the sole power to regulate commerce as defined in the Constitution by Article 1 section 8.

All the Declaration of Independence says is that "men are created equal, that they are endowed by their Creator with certain unalienable Rights, that among these are Life, Liberty and the pursuit of Happiness." It doesnt say anything about health care being a right. Personally, if I were to pursue happiness and liberty, I would like to have access to certain controlled substances at a fraction of the price currently on the black market. Should the government guarantee that? I have some friends for whom being depreived of black market heroin causes them severe distress. Should they be guaranteed free health care in the form of a good supply of black tar heroin at taxpayer's expense? I happen to love my drug-addicted friends, but I dont think they have any unalienable right to expect free preventive medical care in the form of illicit drugs. Personally, I have nothing against such recreational drugs and I use them myself every chance I get, but, unfortunately, it's not the national interest to guarantee my right to use them just to make me happy.

Free healthcare? There is no free lunch. If the governement gave free healthcare to anyone who needed it it would cost more billions than anyone can imagine. Since the only way for governement to get that kind of money is through taxes guess who would pay for this so called free care.
