I respectfully beg to differ with all of the above, in part.
It depends upon whether the state flag and the US flag are being flown on the same staff. If they are being flown on the same staff, the US flag must be flown at the top, with the state flag underneath. This is true for all state flags.
If the flags are being flown from separate staffs, the Federal Flag Code (which is not a law or regulation, but a guideline of proper procedure) states as follows:
When the national flag and a state flag are flown on separate staffs, the flag of the United States of America should be flown to the right (to the flag's own right, or to the observer's left) of the state flag, and from a staff of equal or greater height.
Thus the flag of ANY state may be flown at the same height as the US flag, provided they are flown form separate staffs and the US flag is to the right of the state flag.

As Lango77 pointed out by linking to the Snopes.com article, every state in the nation can fly its flag at the same height as the United States flag as long as the flags are displayed on separate poles which are the same height. If the poles are different heights, by law the US flag must be flown on the highest pole.

I would assume that maybe in Texas they feel they can fly their flag at the same height as the US flag because it was an independent country at one time - but that reasoning does make sense because California (when it was the Bear Flag Republic) and Vermont (the Republic of Vermont) were at one time independent countries also. They do not have this right and the belief in Texas that they do is an urban legend - see http://en.wikipedia.org/wiki/Flag_of_Texas about the urban legend.

In the USA, no state or country can fly it's flag higher than the stars & stripes.
Outside the USA, I don't think anyone would give a hoot.

By federal law, Texas is the only state in the U.S. that can fly its flag at the same height as the U.S. flag. 17ft for all other than the Texas flag with is the same height at 20ft.

texas is correct but if you think abut it not only tx had its own gov. i do recall a capital and a pres. being in Mississippi but Tx is the correct answer
