They can legally refuse...but as is said 'Good fences make good neighbours'... so mention that you have some improvements to carry out and also what times you will need access to their property. If they refuse after that, there is nothing you can do except work from your own side (unless you can discretely access when they are not there). If their side of the fence looks ugly because you cannot access to repair....well then that is there problem is'nt it Whatever, try not to make it a big issue if you intend on staying, as there is nothing more upsetting than not feeling at home in your own home......even if you do have a perfect fence!

You need to check the terms of the contract when you bought the house (assuming you own in, if not, get in touch with your landlord) They usually show the boundary properties and have a clause written in that access will be allowed to repair such things. However, if the neighbour does not have such a clause he has no legal obligation to allow you in.

Well, strictly speaking they could, but it wouldn't be in their own interests. If they won't let you, then try and get them to sign a 'waiver', that is they won't try and sue you if your fence falls down and causes them or their property any damage - If they won't sign it, send them a letter stating that you've asked them to allow you access to your fence from their side of the property to mend it, this has been refused, and they now have forfeited any right to compensation for any damage caused because you weren't allowed access to fix it. Keep a copy yourself and/or send one to your solicitor

Check your house documents. In the UK most give provision that they must give you reasonable access for maintenance and you must reciprocate. If not then ask and see what happens. If they refuse you might be able to see mediation via your local Council.

They would be pretty silly to refuse you entry. As a matter of fact it would be kind of them to lend you a hand as well, after-all they also gain by having a fence between the two houses. When you have finished their please come and do ours ok, i will make you tea and cake.:))
