So I must wait indefinately. They said they'll ship me one if it becomes available but the wait can be a month to over a year. Their represenative told me my other option is to buy their New Model, at a 25% discount. Is this type of practice lawful?

They are so iresponsible! If i were you, i would ask for a refund and look for other store that sells heater. Their way of selling heater are so oldish style. They will make you buy their cheap heater and make you purchase a new heater which costs a lot higher. Definitely, you are already attached to their store, so you are a bit prone to buy from them. That is injustice dude.
REFUND!!

more info would be helpful in answering this question such as brand name and where purchased. This is more of an issue of credibility than unlawful activity and going to small claims is your best bet to get results. There may be some local dealers that can repair this under warranty. might consider looking into that possibility especially if this is a major brand of appliance. If you ordered from a remote source through the internet this could complicate matters in achieving satisfaction. This is the best I can do for you and hope this helps. Good luck.

No, the option is to give you a full refund of the purchase price. If they are unable to provide the same product or a newer model replacement at no charge, then they are in breach of their contract with you. Tell them you will take them to small claims court if they don't either (a) replace the unit immediately for free, or (b) refund the original purchase price.

if they cant replace it with the exact model they should give you an equivalent or a higher spec model if its still under warranty
trading standards will know the exact ruling but check the fine print first

contact the BBB and have them look into this for you. What they are doing is unlawful and they may need to be reminded of it.
