Declaring War is an act of congress. Neither actually declared war. They just bickered and started to fight.

Neither. The Southern states legally left the voluntarily union of the United States and created a completely separate nation. Hitler.....er, Lincoln invaded a foreign nation without provocation or justification.

The way Lincoln got the South to attack first was by sending a re-supply ship to Fort Sumtner(sp?), which they didn't allow through.
