In the state of Illinois, can a job refuse to hire you because you have a misdemeanor? I know they can refuse to hire you because of felonies, because I always thought they couldn't because of misdemeanors.

It's not about me. I have a friend who blames not having a job in the last 2 years on having a misdemeanor for stealing a car or something like that.

I would think that it depends on what the misdemeanor was. If you are trying to get a job as a bank teller and the misdemeanor was anything theft related, they may have a valid reason for not hiring you.
When I was in retail, I generally didn't hold a misdemeanor against anyone UNLESS it was not disclosed on the application and I discovered it in the background check. Our application specifically requested any convictions other than traffic tickets. If an applicant wasn't honest before they were hired, we didn't want them working for us.

Different companies have different qualifications. Look at the section on the application for convictions (or whatever it's called). It will state if they want to know about felonies or misdemeanors and felonies.

Isn't there a law in place that protects people from their past? I thought if you had a clean record for 7 years that the convictions didn't count. People do change their lives. And if they haven't gotten in trouble in several years then they have probably cleaned up their act. Everyone has a past.

Of course they can. That is the reason why employers do background checks, criminal checks and credit reports. Why would they want to hire someone that has a record? Do you think they should trust you?

There might be people out there that would help you, but probably not someone that owns a company. It is difficult enough to get good employees without a criminal record.
