I had a fitness for duty exam paid for by my employer. I asked the Dr. for a copy of this report. He said he would have to check and see if he could give me a copy or if my employer had to give me one. I thought my medical records were actually mine regardless of who paid.

medical records are medical records and under HIPPA, you have the right to see them. Your employer may have a process to request them, but you should not be denied a copy. They will try and make it difficult. Contact your union if you have one.

Drs are not clerks and clerical tasks confuse them.
Next time ask the receptionist , or still, call and ask to speak to records and request they send you a copy.

Answer No. 1 is correct-- HIPPA provides the records are yours but you have request them.
