the fence is all old and broken and keeps falling down. I want to fix it but they don't.how came they help me.

Sorry... If this is your fence then it's your responsibility. If it is found out that the fence is on their property, they can leave it up as is or remove it altogether and you won't have any at all. Stop trying to make someone else pay for YOUR fence. That's not very nice or neighborly.

First, You need to find out if the fence is truly on your property or not. You call a licensed surveyor who will survey your property and mark the boundaries with official markers (usually something that has an orange flag on it).

If the fence runs along your property, you are responsible for the fence. If the fence is outside of your property, then you have no say in how it goes.

I would be very careful when it comes to tampering with the fence.

You can't make them pay for it but the good neighbor will pay their portion. Maybe they can't afford to pay. Either you can pay for the whole project and have it replaced or perhaps if you don't wish to do that you could just build a fence on your side right up next to the other one and leave the run-down one for them to look at day end and day out. That'll teach them!!

There is a saying, "Fences make for good neighbors!"

I think the thing to do is to find out exactly whose property it is on.... and then you can simply asume that the fence really does belong to that party .... and then the argument will be over ....

If its technically your property line, then it is your full responsibility to cover all costs of the repairs. Also, if you really want it replaced, and it is your decision to do so, then you'll be responsible for that too. You cant force your neighbors to pay anything, this is your want, not theirs.

the fence is between your property and theirs , and they should pay half the cost, but more times than not they won't
