i went and had my pre sentencing report done, in it, the probation officer recommended that i just get a fine and have to pay restitution. my lawyer said she was going to suggest i go on probabtion instead of the fine due to the fact that i am 7 months pregnant and have had so many complications that i no longer have a job. (am pretty much on bed rest). do you think that i will probably get either the fine or probation??? is it likely i will go to jail?! what are the odds of him going against the recommendation?

have always been polite to the judge, using yes sir, no sir, yes your honor, ect. dress nice, and have no prior record.

It would certainly help to know with what you are charged.

But if it's nothing too serious, the judge will probably give you a fine and/or probation in lieu of the pre-sentencing report and the fact that you are 7 months pregnant. If your lawyer wants more probation and less fine, the judge may do this if your financial situation is not good.
Again, I doubt you will go to jail unless the charge is really serious.

I guess it kind of depends on what you got busted for...if it was a minor mis-demeaner, you may just get probation. If it was really bad, you could end up in deep doo-doo...you weren't very open about your case, so it's hard to say. Anyway, best of luck to you!
