My friend was rape.d and her b/f and I have talked with her about turning the two guys in. She says that she won't do anything b/c she gave up fighting back when she knew it was hopeless and in the eyes of the law, that makes it legal.
Is she right??
The second reason why not is b/c the two guys were old friends of hers. She tried to fight back but ended up with a broken wrist and broken ribs.

She says that her counsler told her it isn't rape if she gives up fighting. I think it is. Is it??

It doesn't matter if she gave up fighting, it does not in any way make rape legal or okay. She could still press charges but the longer you wait the harder it is to prove. And as for the second part of your question...rape is rape. It doesn't matter if it was date rape or gang rape or statutory rape...it's still illegal and they should still go to jail for it.

Rape is Rape.
The broken wrist and ribs are proof enough that the sex was not consenting.
The guys we NOT old friends of hers. A friend would never do that to another friend. If they raped her, they would do it again. If she doesn't report it she is guaranteeing that another woman will suffer the same fate, or worse.

It is possible they had done this before to another woman who didn't report it. If she had, your friend would never have been attacked by those guys.

Don't be confused... gang rape and date rape are simply a description of the circumstances around the attack. The law makes no distinction between them. I believe like murder, there are varying degrees and acts. Sodomy, sexual assault, and rape are considered separate offenses and could all be brought as charges against the same person if the circumstances applied.

Her boyfriend isn't worth having if he did nothing and will do nothing to protect her. The least he could do is to support her in bringing her attackers to justice so she could live in a little less fear and to let her know that there is no shame for her in this.

By NOT turning the rapists in, you are protecting them and are a partner in their crime.

Do YOU feel comfortable being a rapist too? How will you sleep knowing that you could have protected the next woman? What will you think if you ARE the next woman?

How about if they kill their next victim, and you could have prevented it? What then?

If your friend says no but someone forces against her will sexual intercourse, even if she doesn't fight, this is a case of rape, but hard to prove.
As your friend has fighted until it seemed hopeless to her and her wrist and some ribs were broken, it is a very severe case of rape, joint with bodily injury. Please encourage your friend to take legal action quickly. Rape is a crime against the dignity of a woman. I can understand your friend if she feels now she should have fought harder, she made it legal, but that's not the case. Perhaps your friend thinks now how such a disgusting thing could have happened to her, and the only answer she can find is that she is guilty. She is not, the 2 guys are!

Its still rape if she stops fighting as long as she is not "consenting".
