I know regulations probably vary from state to state. I have an unfinished basement (new build) with plumbing. I am considering constructing a commercial kitchen for small scale food biz.

As long as you pass all the health codes I don't see why location is a problem.

But being in basement may be a bit hard to pass the fire codes, maybe?

Ask local health department. In the Grat Lakes area, most states will work with you--especially if you get their input while constructing the kitchen.
