My friend was rape.d and her b/f and I have talked with her about turning the two guys in. She says that she won't do anything b/c she gave up fighting back when she knew it was hopeless and in the eyes of the law, that makes it legal.
Is she right??

The second reason why not is b/c the two guys were old friends of hers. She tried to fight back but ended up with a broken wrist and broken ribs.

It is rape - once force is applied - and the victim becomes tired or knows it is better to surrender then to be badly beaten it is still rape - Any slight penetration against a person's will is RAPE.

Yes, reporting it my well stop any chance of the rapists doing it again. That aside though, this is an intensely personal decision. If she is to see it through she will have to relive the rape, in front of the accused. She will have to explain to a courtroom full of strangers that she submitted at a certain point. That does not make the rape right but I think I can see why she thinks the way she does. If she truly cannot handle reliving what must be an awful experience, she has the right not to press charges. That is not helpful to other women but it is, nonetheless, her right. Maybe she considers that is the best way to get on with her life.

You have tried your best, I'm sure. If she will not be moved on this issue, I think you have to respect her wishes and offer her whatever other support she needs.

Being a victim really stinks. You get little support, you doubt yourself often, you are scared, alone and helpless. Support your friend and stay by her side.

But be firm. If she allows this to happen without consequences to the suspects she will be a victim forever. It will never go away. Use the support groups in your area. Call the police, the hospital, the hotline. They all have people who can listen, suggest and be there.

Good luck, remember, attitude is a choice, from a 32 year cop vet.

No. She should definitely press charges against those two men. Rape is non-consensual penetration. Even if she gave up fighting because she was physically exhausted (and feared that they would kill her if she did not stop trying to resist them), that does NOT amount to consent.

I pray for your friend's recovery from that terrible ordeal, and I wish her the best of luck in court. I hope that the courts impose the maximum penalty on those perpetrators who committed that heinous, unwarranted crime against your friend.

Agree w all the previous, (nice to see only responsible replies)and as stated NO is all it requires.

Her failure to continue resisting is NOT an issue.

A person may have been consenting & invite someone to their home, etc & change their mind before it happens. NO means NO at any stage.

Prior consent does not mean perpetual consent, period!!

No. She never had to fight back she just had to say no. She may not want to involve the police for other reasons known only to her. Like there were illegal drugs consumed, she was drunk and consented to one guy, she consented but regretted it later, etc. If she feels she was raped she should report it to protect other women from predators.

No. Consent achieved by coercion is not consent, which must be freely given by someone who can refuse consent without harm. IF she really was raped, she certainly should file a complaint, because they will do it to someone else, which she could prevent.

If nothing else you should get her to a Rape Crisis Center for professional counseling. They'll be able to advise her on how to proceed.

That's nonsense. No means no. Even if it's your husband, and you say no, and he continues he can be arrested for rape. Rape is never legal, and there is no act or omission of an act that makes it okay.
