So here's the deal...

I work 30 hours a week, but due to short staff I have worked a slightly odd shift.
On friday nights, I am scheduled to work a 4pm to midnight and then come back to work at 8am the next morning and work until 4pm. Would this be considered overtime given that I only have an 8 hour break before my next shift?

This is the third week in a row that I have done this for this month and I have done this numerous times over the last two years?

Also, I mentioned to my manager that I recently found out that I am pregnant and since then he has not modified the schedule.

I've been researching the california laws of labor, but still cannot tell if this applies to me.

Thanks.

They've changed that law back and forth so many times I can't keep it straight.

I'm salaried, so it has no impact on me.

Try this site from the Labor Board. http://www.dir.ca.gov/dlse/FAQ_Overtime.htm

Overtime is based upon the number of hours you work in a weeks time and on the number of hours in any one day you work.

You have to work 40 hours in one week and 8 hours in each day and then anytime after that is considered overtime. You probably don't qualify for any overtime on a 30 hours schedule.

If you're working a closing shift one night and on the next day working an opening shift and it's less than 8 hours inbetween is not a situation considered for overtime. It's just bad scheduling.

Yes it is. No overtime for exempt employees
