If it was seized by the child support agency then yes, the custodial parent will get the money--if the arrears are due to him/her. If it were seized for a TAX JUDGEMENT (which I believe is the only debt to trump child support arrears) then it belongs to Uncle Sam.

Federal tax intercepts are generally held for 6 months prior to releasing them (if the non custodial parent is remarried). State taxes are first used to pay off debts owed to the state (substitute care, TANF etc) anything above those debts are applied to what is owed the custodial parent.

Was his money garnished for child support? Did you have an order in effect? If not, it may have been garnished for something else. But if you did have a tax intercept in place, you (custodial parent) will receive it. It will be credited to his arrearages on your case within a couple of weeks and then it will be held for 6 months unless he signs a release (it is held so he has time to protest it). You should be able to get this information from your child support caseworker in a few weeks. That is, if you went through them but I think that is the only way they will garnish it.
