I am in the middle of getting divorced, and I have been selling some nude photos because I am broke and need to pay my school loan. My husband has the same photos on the computer, does he have to give them to me, or am I out of luck?

you are still married, so no he doesn't have to give them to you because they are part of both of your assets.

He is wrong for not giving you the pictures from his computer.
If my wife and I was going through a divorce, I would give her everything that she wanted that was personal of hers.
That is sad that you have to sell pictures to pay for your school, because your husband should have assisted you with the education program while you were living together.
If my wife wanted to go back to school, I would find a way to assist her with the educational program for her, and my children as well.

This is why you don't take nude photos. The ONLY person other than your Dr. that should see you nude is your husband. What he's doing is wrong by not giving them back to you. But sellling pictures of yourself naked?? To me it's no different than selling yourself.
Your husband cheating on you was wrong, but I don't think it's right that your selling pictures of yourself naked to people.

You can file a police report but, I imagine he'll lie about ever having seen them. He might tell the cops he got them off the
Internet which anyone can do. I would just forget about them.

be sure to list them in the divorce as marital assets and you can get at least half of them

nope he doesn't have to give them back...LEGALLY he is still your husband and those photos are part of the "marital assets".
