and we have a daughter together.I was wondering can he clam my son on his income tax.We live in texas.I havent worked in a year. So i know i cant do anything.

I would say yes if your son lives with you for more than 6 months out of the year.

LADIES AND GENTLEMEN, this is a classic example of why this country is in such rotten shape: Here you have a woman who has a son from one guy, a daughter from the guy she's currently living with but still not married to, and her question of the day is who can write the first kid off as a tax deduction??? Does your son live with you? If so, then yes you can claim him but your fiance cant because you two are not married yet. Once you get married then he can claim you all...

As long as he's provided 50% of their keep for last year he can claim anyone no matter what state you live in.

does Texas still have common law? if so your already married. if you file together yes he can claim him. If you don't then he can't claim him as child, but maybe able to claim something if he does the long form and idemize things, but thats it.

Talk to tax folks like H&R Block I believe he can claim head of household and both you and your kids as dependants

i think he would have to get legal custody of your son first before he could claim him on taxes. you should probably consult a lawyer about all this if you wish to proceede with custody.

he can as a dependant if the boys dad isnt claiming him. he can also claim you as a dependand
