Why were you detained in the first place...you may be able to get it back eventually, but doubt you can "bust" them for theft, since it was confiscated during some kind of investigation...you can understand why they may see it as a safety issue, correct?

You can take back your knife if no crime is charged against you. Tell them that the knife is legally possessed for a valid purpose such as job and cooking.
