The answer is absolutely -- yes. But it's not stolen. Copyright laws do not pertain to titles. You can copyright the content of a book, but you cannot copyright a title. There are several copies of books, for example, entitled "Invincible." (Movies, as well).
Sorry, but titles do not enjoy copyright protection.

Yes, but even if someone does, you will have proof that you came up with it first. And since titles cannot be copyrighted you will still be able to use the title.

Yes, unless you have copywrited it. Even if you've done that it can still be used unless you can afford to litigate against someone who does this. The law/constitution only protects you in so far as you have the ability to protect yourself by either representing yourself legally or hiring someone else to do that for you.

yes if not copywrited...and if they used it and didnt copywrite it, then u can use it again, since its 'free' and not a claimed title .
