I think that the laws regarding what to do in case of an accident, mandate that both parties remaining until the police arrive. In any accident, try to get their insurance info before they leave. If you call the police and wait for them to arrive, you will not be charged with a "hit and run". The other driver will be charged because it is illegal. Even if someone seems so nice and that they want to help. Just remember, if you can't get their insurance info, write down the tag number. When the police arrive, explain it, and you should be fine.

You will not get in trouble but I would still wait for the police because if they leave and then try to say there were more injuries or damages the police man will testify that they left and they lose a lot of ground. If you leave before giving information and you hit them, its a hit and run.

It's leaving the scence of an accident IF there is 1,000 dollars or more in damages. I just talked to a lawyer about this two days ago
