I first of all was foreclosed on and didn't know what to do. People advised me to file bankruptcy and so I did. My attorney said my best bet was to file chapter 7 which discharges all debt, however he said it would be a miracle for me to stay in my home. I am at a loss and want to know if anyone out there has ever had such an experience. My ex husband also has cancer and has not been able to pay child support for a while because of not working and I think I am screwed, help?

Unfortunately, if the house has been foreclosed upon, there really isn't anything you can do to get the house back unless you redeem it within the redemption period. Usually, the only way to redeem property is to move within a certain time period after the foreclosure, then you would have to pay the loan in full by the redemption period deadline.

The bankruptcy removed all liability you would to the mortgage company.

Filing for Chapter 7 bankruptcy does not relieve you of your duty to pay the mortgage in order to keep your home. Sometimes debtors will file a Chapter 13 to repayment the past due payments over time. Sometimes debtors will negotiate a forbearance agreement directly with the bank allowing them to catch up.

If the bank foreclosed at a time when you were not protected by the automatic stay, you are probably out of luck. Nonetheless, you should consult a local bankruptcy attorney for further information.

first i would of never filled for bankruptcy. The laws have changed and you just get screwed by them. You will lose your home. The best thing to do is get an appartmet for you and the kids, or live with family members. You can get child support. If your ex is collecting any ssi money, they will deduct that money and give to you. I would check into that one.

If your husband smokes then you buy life insurance and health insurance and disability insurance.
