I have been living in the house for 13 years and paying all the property taxes on it. The house is in my uncles name and he wants to just give it to me. Is this possible? And what do I need to do? There are no liens on the house and the property taxes are paid in full. He hasnt lived in the house for 25 years but has been letting me live in it, with the understanding that I pay the taxes and take care of all maintenance.

It is good that your uncle is willing to give you a house. There are two ways of doing this.

You can go before a notary and sign a quit claim deed, and get the deed notarized, after which you then take the notarized deed to your county court house to get it recorded. This is legal as well as the cheapest way of doing this transaction.

The best way to do this transaction. Look in your local telephone book and call a local title company, tell them your uncle want to transfer the title to his house to you. They will set up an appointment for you to come into one of their offices, where you will sign a deed in front of their notary. They will then make sure the deed is recorded at the county recorder's office.

Even though this cost a little more in the long run it will save a lot of potential problems.

Before you do either of the above,you might check with a CPA or who ever prepare your taxes, there could be tax implications for both you and your uncle, that the two of you should be aware of.

You dont need Probate unless your Uncle is niether uncapable of knowing right from wrong or he is deceased.

What you need to do is contact your local County Recorder's Office. Get the correct paper work and fee's in regards to filing a GRANT DEED as A "GIFT". The County Recorder's office will have some type of language that they would like to see and may want you to put Recording Identification Number on the Grant Deed.

Than you will want to get a GRANT DEED from either a local bookstore or Stationary Store. Figure out how you want to take Title.

Next you will need to get the information Notarized. Once Notarized you will walk it into the Recorder's Office and you have yourself a new home. Since it's a Family Intertransfer you can possible get the same taxes as you are paying right now without it getting reassessed.

Dont have your Uncle sell it to you.

How do I know this. I do this for my clients all the time. Easier than most people make it.

If your uncle wants to transfer ownership of his house to you, he needs to execute a deed of donation in your favor and have it notarized. Present the document at the proper government office where that house is situated in order to effect the transfer of ownership. You will then receive a certificate showing that you are now the owner of the said property.

All he has to do is sign it over and put gift on the back and he can do that with no questions asked being a relative. That is all there is to it.

Contact your county's probate office and they will tell you the steps to take. I don't know if closing costs are going to be involved or not.

should be able to go to local courthouse and do a quick claim deed
