It is very very obvious, because Eric had the gun but no bullets and as the movie goes on Jigsaw gives him bullets and tries to convince him to kill himself. Thats why he gave it to him in the firs place.

It was empty, when he pulled the clip you could see the bottom of the clip(it was a red piece of plastic.
