I just received one of those jury questionnaires which means once I fill it out and send it off, I will probably be receiving a jury summons soon after. On the questionnaire it said that I can possibly be excused if I am a legal guardian and caretaker of a child under the age of 12. I’m wondering if anyone has been in a similar situation? Were you able to get out of jury duty?

I understand that is my duty as an American but that was not my question. I was asking for people in similar situations to comment. I have no one else to care for my child and if I am stuck on a case for a week or 2 weeks even, then I would be in a VERY bad situation.

you should be able to get out of it if you have a child at home.

When my son was just 12 days old I was summonds. I am a stay at home mom and was nursing. The only way I got out of it was because we had just moved states. I'm sorry I could care less about my American duty to serve on the jury I wouldn't have left my newborn for anything!!

I have been in the same situation. I usually call the number on the summons and I explain my situation and they tell me what to write on the summons and I then mail it. I too am a stay-at-home mom. I can't afford a sitter for a day, never mind for weeks if I have to be on jury duty for a trial!!! Don't pay attention to people who make a big deal about you getting out of it. They don't know your situation. If anything, tell them to go and babysit for you for free!!! Besides, good chance that we will do it eventually, when our children all attend school full time.

Yup... I've never been able to serve because of the Kid. I would love to, but taking a week or two away would not be good for the family. There should be a form on the back of the summons that you can fill out. They wont question it if you put that you take care of children.

you can make an excuse like most people , or stay & enjoy the jury duty... It took 120 jurors to fill a panel of 8 in my state

first of all i do not think you are asking something that is not an honest question. I would tell the authorities your situation and I am sure you will be excused. People have gotten off with a lot more sillier reasons.

First, you WILL be summoned to court to be examined. While you are there you can petition to state your situation and explain how there is no one to take care of your kids. Also, look up your state laws. In some provinces in Canada they will pay for your daycare costs.

If not, you might want to look into babysitters in your area asap. Usually you don't have too much time until you are called in.

i was always excused because i had no replacement at work or because i was disabled and was on strong meds and possibly couldn't make a right decision, plus i cant sit or stand for long periods of time that's how i got out of it was with a Dr excuse. but i never heard of it if you are a stay at home mom.

I believe you need to go but you can tell the judge that you care for a young child and have no one else to care for that child. I think you will be excused. best of luck
