so here is my story... I got married 6 months ago... he is 17 and now we are not working out and splitting up... we live in virginia... what all can i do? do i have to have an annulment or a divorce? Also I had my own bank account with out him on it and he maxed out my account I reported it to my bank but what else do I do? After the annulment or divorce would he stll be considered a minor?

Probably have to have a divorce.

You need to talk to a local attorney.

Short-term marriage is not grounds for annulment. I assume that the marriage was legal (ie he had parental consent)? Unless there’s something you haven’t mentioned, you’re likely going to have to get a divorce.

How exactly did he max out your bank account if he wasn’t on the bank account? Did he forge your name on a check? Use your debit card without your permission? What did the bank say when you reported it, as far as what action they could take on their end? Did they recommend filing a police report? At the very least, this needs to be brought up in the divorce proceedings.

He is STILL a minor, but he’s an emancipated minor (because he’s married). I’m only aware of one state (which is not VA) where a minor who has been emancipated by marriage is then “un”emancipated if they divorce before turning reaching the age of majority. But…why does it matter to you if he’ll still be considered emancipated or not?

You need to consult with a lawyer who can give you what options are available in your state regarding annulment vs. divorce.
In my state, an annulment can be granted ONLY if it's within a certain time period after the marriage and trust me, it ain't 6 months.

Good luck. Some lawyers will do it "pro bono" which means for free (it actually translates to "for the good" but who cares)

If the marriage was consummated (if you had sex) then the only way out is divorce but it can be easily done with a no contest divorce sense there are no kids. You both have to agree to the divorce.

Yes, if he's still 17 after the divorce he's still a minor.

She is 23.... sounds like you're in a hurry to give up? Marriage is not a weekend role playing event! It takes years to learn to live and love each other. Maybe you two should visit a marriage counselor first?

you might check with an attorney. i think the rule is--under a year you can annul after that you have to divorce.
