I live in a apartment building, there is only one way to get in and out of the apartment building. There used to be two post to hold on to. but one of them has been broken since August of 2006. The landlord come here all the time and dont fix it. He just leave it. Right now it is winter and there is alot of snow and ice at times, but it hard sometimes to walk up and down on these steps, and than one of the post missing, you dont have any support. If someone was to slip and fall , hurt there back or even broke a bone. Due to the negligance of the landlord. Could you sue him for pain and suffering and stuff? What would be the proper steps in filing a lawsuit?

Depends what state you live in. What is their negligance? You should have a copy of your lease.
Get the name, address and phone number of who you should contact if you have a problem.

Do not make any false statements to the landlord in your application to rent the property. This may be a violation of the law and cause you further problems if you have a dispute with the landlord.

Before you sign a lease, read it carefully. Make sure the lease says what you have agreed to. If not, do not sign it.

Always keep a copy of your lease.

I suggest the above link. But not knowing what state you are in makes this hard to answer in detail. Use your search engine to search within your state.
Good luck.

You will most likely have to file a writ in small claims court , basically you go to your closest Court house , and there at the front desk you will be directed to the offices of small claims court , which i believe is for law suits of up to 5 k . you don't need a lawyer , there you will have to fill forms and just follow instructions and dates will be set for seeing the judge , you will have to deliver the writ to your land owner by person .
