File "married filing separately" (with higher taxes, of course)

You are not single so it would be against the law if you filed that way. I suggest you file a joint return as there are obviously no divorce proceedings and in the event he itemizes you could wind up paying through the nose (I know I wound up having to pay over a thousand dollars when I made less than twenty thousand. that year), at least if you file jointly you will be able to get half of whatever the two of you get back which any way you look at it is a hell of alot better than paying

If you're still married, you can file as married filing jointly. You can also file as married filing separately, however you usually get more benefit out of filing together. Most couples file together, because it usually is simpler when there is mortgage, etc. expenses involved that you both can deduct for.

If u have been separated that long u need to file (married filing separately) if u get a divorce then u can file single....

you can file either sep. or together, and yes you would get more filing together. but here is the catch to that. if your husband is notified that this money came in, he can go pick up the check with out you, sign it and cash it. guess what nothing you can do about it. trust me my brother did this very same thing. she went and got the refund check and cashed it. he could not file charges on her because the story goes, what mine is yours and whats yours is mine.

You can do either. You save on taxes if you file jointly.
