It is joint property. So technically you are entitled to half of the money, but unless you have filed for legal separation, or for a divorce, there's not too much you can do at this point. Now I would open up another account in your name only and go from there.
You can try to file a small claims case, but a lot of states won't allow you to sue a current spouse. You would need to be divorced.

If you cant close the account on your own, meaning you need him there to close it with you, then dont put any money into that account. If that was the only account you had, open a different one. Theres no way you can get that money back. If you file for divorce, its hard to get that money back, unless it was thousands of dollars and you have proof he took the money in the first place.

close your account right away! if the other person is on the account, they have the right to withdrawal money from it. so don't add any money into the account, in fact take out all that is yours and open a new account with only yourself on it. you may not even be able to close the other account without having the other person there to sign the papers. if you want to try and get the money back, you might be able to take them to small claims court, depending on your situation. you will have to prove that the money they took out was put in by you, with either direct deposit info or pay stubs and deposit receipts.

You have to try and close the account asap ... other than that you are still responsible for EVERYTHING ... my ex-husband and I were living in different states - he took all the money out and even took as much overdraft as he could. The banks tried to contact him but he refused to pay ... so where did they go looking - me - I had to pay everything off - in payments since my name was on the account to - and I didn't want it sent to creditors ... be careful ... very careful with joint accounts ... people get screwed all the time ... !

Depends who opened the account, as if you opened the
account then you are the principal account holder and if
he did then he is and if that is the case just open up a new
account in your name, and deposit money into that accnt.
