It depends on the circumstances and if there is a court order barring this. If you couldn't take a child out for any reason, someone who lived by another state's border would go to prison for going to a Dairy Queen in Mississippi...

No. You cannot take the child out of any state w/o permission from the other parent. If you do, you can be arrested for kidnapping, and if the other parent is no good, your child can end up a ward of the state. DON"T DO IT FOR YOUR CHILDS SAKE!
