From what I've observed, it's almost always better to file together, both in terms of refund and in terms of avoiding an audit. Of the problems I saw working in a tax office in years past,(although I only covered receptions and scheduling), the majority of the issues raised were over married persons filing separately. You can actually go into HR Block, and ask them how much more you'd get back either singly or jointly filing. They won't charge you a penny until you agree to file a certain way, and if you decide you don't want any help filing, they won't charge you for coming in and checking things out. I was really shocked working for them, because only one out of three appointments actually used HR to file (the majority use their "double check" feature which allows customers to ask a tax preparer if they have filled everything in correctly. The preparer says yes or no, and then they are free to file on their own, usually online). Any more questions, email me (use the link on the profile).

File separately and let him claim head of household with you child. He will have a larger tax, but it will be off set by claiming your child. You should file married but filing single.
