They can hold you for 24 hours without being arrested. To get indicted, you must have been arrested and then brought up on bail/bond. You typically can be held up to 48 hours before this procedure is done and then the judge will determine whether or not you can be released on bail until your indictment trial begins. To be clear, an indictment is when a jury hears the preliminary evidence and arguments and makes a decision about whether or not they have enough evidence to go to a full trial.

Use to be 72 hours and then they had to press charges or let you go. But now that we have Patriot Act in place and habeas corpus is gone....they can lock you up, toss the key away, forget about you and there is nothing you can do nor a lawyer.

Thank Bush for taking our rights away and destroying the Constitution.

.they can hold you untill they book you. which could be anywhere from a few hours or a few weeks. after you are booked and are not being charged from that point on they can hold you for 24 hours.
