come over and walk in whenever they want to. My in-laws have a key to my house for emergencies only but now that my husband and I have a baby they feel that they can just come over and walk in when ever they feel like. Is this legal and what can I do about it?

no, it's not legal, when i rented an apartment, my landlord had a key for emergencies but he legally couldn't just come in my house for no apparent reason. as for what to do, you need to have your hubby explain to them that you both are uncomfortable w/ them coming in at all hrs. have your hubby do it so it doesn't seem like you are attacking them or don't like them or don't want them there. and make sure he says both of you feel this way and not just you or they will think the same things as above. good luck.

they technically have a key so they are technically not breaking and entering. BUT you seriously need to have a talk with your husband before you speak to your in-laws.. make sure he does the talking so it doesn't look like you are complaining.. you don't want to look like the bad guy.. They need to understand that you, your husband and kids have your own lives and that you appreciate them coming over..
you could always change the locks on the house. just let them know you lost your keys and that's why you changed the locks.. and that you will eventually get around to giving them a spare .. or maybe put an extra lock on the inside of the house.. so its locked when they decide to waltz right through the front door.

It's perfectly legal if they have your key...because you gave it to them.

It's also perfectly legal to break into someone's home when there's an emergency...for shelter, or food, or phone in a desperate situation during a life-threatning crisis like being stranded on highway 66 and your house in the only place available for 30 miles all around.

Unfortunately, if you only wanted them to rely on you for an emergency...you should have given them contact numbers and a hidden location of a spare house key.

You could take the keys back and tell them that's not what you meant the keys to be used for. Tell them that you would prefer for them to call before they came over and that you'll have a spare key hidden and you'll tell them where it is when you find a good place to hide it on your property.

Just tell them what you need to. You won't get what you want without saying it out clearly. If they get their feelings hurt, they'll get over it. Better to have your privacy and your peace-of-mind that having them over unexpectedly and constantly thinking about it over and over.

By giving them a key you gave them opportunity to come and go as they please.

You have two choices...
1. Sit down and talk to them about it. You both would have to tell them that the key is meant for emergencies only and you wish they would respect that. Make sure you let them know you love the time you two spend with them, but their just entering whenever they wish interferes in your "special" family time.

2. The other option is to outright ask for the key back. Let them know they overstepped the boundary of the reason the key was given and you no longer wish for them to have that responsibility.

If you give your key to anyone for emergencies - it should be someone youtrust to only enter in case of EMERGENCY. A whim to enter your home is NOT an emergency.
Having the key does not give them the right to enter your home if there is no emergency.
Take the key from these people - or have the locks changed or re-keyed.

That totally sucks and I would ask for the key back. What an invasion of privacy! Next time you see them coming get naked and walk around the house. I bet they will knock before entering the next time! I am glad my in laws live 7 hours away! I feel for you!

Girl, I'm sure you're not going to sue your inlaws, are you? So the legality of it aside, it's morally not right. Sit them down and tell them that you really trust them and that's why they have the key. And that you're happy they want to be around the baby as much as they do. But when they walk in without knocking it makes you feel uncomfortable and it makes you feel like you have no privacy. "Come over, but please respect my privacy." Hopefully they'd hear that.

You'll have to talk to them. Ask them to stop doing so because it's still your home and you need your privacy and time alone with your baby and your husband. Tell her that if they can't stop acting like that, then you'll have to take their key away. Nothing personal to them, you just can't have them coming over uninvited and unannounced.
