Is your husband competent? Can he sign documents without someone saying he didn't know what he was doing? Is the house in his name alone? A lot of questions need answered before knowing the answer to your question. If he is competent, he can either sign a will or sign the house over to you. The law is different in each State so its hard for me to say what Texas law is. Do you know how the kids feel about this? Best idea is to consult his doctor to find out if he's competent and then talk to a lawyer about it. He will know your rights.

Maria - DO NOT RELY ON YA PEOPLE! Seek advice from an estate attorney.

Does your husband have a Will? If so, you need to get a copy of it! That document will spell out what his intentions are for disposal of property once he's passed away.

The only one that can truthfully answer your questions is an attorney who knows that area of law. Call your local bar association for some referrals.
