I would like to believe that custody goes to the most capable parent that has the best interest of the child at heart.

Not always and joint custody is exactly what the court wants to see. It doesn't mean equal parenting time, but it does mean you have the same rights as the other parent.

Get an attorney and see if you and your wife can work out a parenting plan that works for you and your children.

Best of luck!

If the child or children are old enough, let them address the court & tell a judge where they want to be & why. Unfortunately, guys get screwed 95% of the time but I think that if you fight back hard enough it is the only way things will change in our "wonderful system", to reverse the screwage. Remember 1 thing, children are a blessing not a weapon and times are changing but they are changing a little too slow for fathers' rights. Just plant that seed and pray it grows

Good luck, the biggest loser in this story is your kids. Joint custody, or shared custody, is probably the best you can hope for. Make sure your kids know that you love them. You have a very rocky road ahead of you. The best thing to do is get a lawyer, immediately, do NOT try to handle this alone.

The wife doesn't always get custody. If you can show that you have a safe place for the children, and are able to get them to school, etc., then you should be able to share custody.

more courts are opting for joint custody than ever before. get a good lawyer who will work for you and not just agree to what her lawyer wants. generally, the parties need to be reasonably amicable before joint custody will be granted.

Nowadays it is easier to get Joint custody. As long as you have not done anything that will go against you.

It depends on what state you're in. From what I understand most states now look to see which parent the child would be better off with.

LOL! You are a comedian. Men get screwed all the way down the line in a divorce. The only equal 'right' you are going to get is to work your tail off to pay child support for the brat. The bias in favor of women is so overwhelming as to be criminal.

not always but most the time its pretty hard to get custedy unless the children want to live with you or if you can prove the mom unfit. but there is a chance that the father could get custady to.
