No, there is no law that says you have to file together. Most do, because there are certain deductions married people qualify for, but you have to file jointly to use them.

The risk, you may not get as big of a return, or end up paying more if you owe money.

But, if you really want to file separately, it is legal.

No. You don't have to file together. If you don't file together one spouse may end up paying more taxes and neither can file for earned income credit and certains other credit and deductions.

But, on the other hand if you need a refund, one spouse may claim the children.

and let's not forget filing head of household. You can only do that if you DID NOT live with your spouse for at least 6 months of last year. I'm divorced, but between marriage and divorce we lived separately for a couple of years and I was able to file as single/head of household because we didn't live together for at least 6 months of the tax year and I provided for more than 50% of the living expenses.

It's called Married, filing separately. My bf is doing this for the years 93, 94 & 95...they never filed those years so he is taking care of his end of it.

No, you just pay more tax if you file separately. Some people have reasons for this.

No, it is no risk if your spouse isn't going to file have them sign a waiver, if they are tell them what you want and wait and see what they want and the judge will decide, who gets what.

you will pay more tax filing seperately, there is no advantage filing seperate
