In my divorce agreement, I allowed my ex-husband to keep any possessions we had because they meant nothing to me, as they were odd things that were picked up through the years, and furniture & dishes that I could easily replace. I live 1300 miles away from him in another state. The agreement did state however, that he was return to me all my personal mementos, such as diaries, poems, letters from my family, and half of my children's photos (and all photos of my side of the family), and half of my children's artwork/schoolwork (that I alone was saving), as well as anything that was uniquely mine (gifts given to me). To date, he has only given me a few small trinkets, and I threw those things away. I have custody of our kids, & I think he is keeping these things to have control. He works, but at a low-paying job & he is on public assistance. Suing him will likely do no good. Pulverizing him is not an option. Anyone successfully retrieved their possessions from a psycho?

I didn't want to leave those things behind. We planned to move out of state together & we had these things in a storage unit that he secured in his name only (he did this behind my back). I tried multiple times to get them back while I was with him, but he was such a packrat that the unit was filled floor to ceiling with junk (literally). I needed him to go with me to get it, and he never wanted to. Then, he took my daughter from me and left me, and all I had was the few possessions I had with me (since most of our stuff was in storage). I've started over & made a great life for myself & am engaged to a great guy. I agree that my ex is a loser & I shouldn't waste any more time on him. I don't waste time on him - it's just that my parents & brother are dead & many of the pictures I want are of them. When we sold my parents' house after they died, somehow the family photos my parents had were lost. This is all I have left.

I like your answer to the last question you helped someone with, so I read your question and am here to tell you something I once heard regarding your situation. First of all, you should be able to talk to your divorce lawyer. I believe he/she should know what to do. Secondly, usually US Marshalls will accompany you when you go to retrieve what is rightfully yours and what is stated in the divorce agreement. My heart goes out to you because I have photos of myself and my brother that my father would like to have or get copies of since my parents divorced and there are only one set. I went as far as getting a DVD burner to make discs of pictures so they will be saved forever. I am going to make copies for anyone in my family who wants them. I am sad to hear some of your family photos are gone now. Do not hesitate to talk to your lawyer and get this done as soon as possible. 1300 miles is a distance, but plan this out with a lawyer and have the Marshalls on standby so when you travel the distance they are waiting to be called. All of this should be possible through your lawyer. I am happy to hear about your engagement and want to wish you congratulations. You are a strong woman and you deserve the best life has to offer. One more piece of advice. If your ex has "taken" your daughter, he may be breaking the law and you may be able to remove him from the situation legally by reporting him to the authorities. Unfortunately if u want them back u'll probably have to go get them, u'll have to take the judgement to the local police department, and have a police officer stand by while u collect ur things..

And i have to ask.. why on earth would u of left with out taking such things? First things i think of when i need to vacate any place ie "hurricane" etc.. the first things i grab are my strong box which has all my important papers in them birth certificates , ect.. and my photo albums of my kids.. because these are things that cant be replaced.. so why would u leave them behind to begin with???

You have basically 2 options: Go back to court and get an injunction that would allow you to enter his residence and obtain any items you desire while under strict observation of a sheriff or Marshall (this probably WON'T happen).
--OR--
Write your stuff off as gone. He has probably tossed it all anyway, so even IF you got that injunction, you'd probably find NOTHING.

My former husband took all of my figurines and ANYTHING I held dear and used them for golf driving practice. Needless to say, there was nothing left when I got my court order.......

No, and regardless of your court order, let it go!!! Get on with your life. How much more time do you want to waste on that loser? Thank your lucky stars that you have all of those miles between you, it make for a much better fresh start.

Regardless of an agreement, 90 days and the things belong to him. Maybe he got rid of them to get at you. Can you prove he actually has them?

You should go back to court and inform the judge that your ex is in violation of divorce agreement/divorce.

If you can't afford a lawyer, use a public defender to get the things you want back!

Tell him he either returns your items to you or you will sue him for possession of them and he can either figure out a way to get them back to you or reemburse you for the cost of them.

you need to go to that town and file a police report(take your agreement with you) and have the police escort you to pick up your things--
