in dec i went into debt and now have a debt mngmnt programme being sorted out, one of the seven creditors are demanding payment from me direct for which they are making 15 tel calls to me per day for the last 2 weeks and still going on.i spoke to them 6 times explaining that the agency dealing with this will be making an offer in due course and all this creditors kept saying that until a pasyment is made they will continue to make these calls.i have kept a record of the calls seen the police and the trading standards who are looking into this for vit is classed as dcriminal although iam entitled to legal aid the solicitors i have spoken to will not take it on what chance do i have on representing myself in a mag court or does someone know a solicitors in london that can take this on.

Put your request IN WRITING and mail it to them certified mail.

Once you get the return reciept that they have received it...the next phone call you get from the call a lawyer.

Talk to a "debtor's rights" attorney. If this thing is a debt collection agency (as compared to the creditors) they might be violating something called Fair Debt Collection Practices Act. You can win statutory damages (i.e. a penalty) per violation, and your attorney can get attorneys fees. Alternatively, you may even be able to bring a state claim for harassment or invasion of privacy (if they're really calling you 15 times a day). Plus, having an attorney allows them to contact the attorney rather than you. Most attorneys who do this work won't charge for an initial consultation, and will only get paid fees if you win. Contact your local Bar Association and ask for someone who does work in the area of "debtor's rights" or FDCPA work.

(Whoops. I just now see you're in London. US law, and the FDCPA, doesn't apply, although I'd suspect that a common law harassment claim may still apply. As far as self-representation in the UK, I can't tell you anything. I'll leave my answer up, though, for any US residents who may have the same problem.)

I wouldn't advise you to represent yourself in court, I am in a similar position and offered the companies £5.00 per week in writing as that is all I can afford, I explained that I had to sell all my possessions to pay off private debts.

They won't go to the expense of taking you to court if they think you have nothing.

Complain to the ombudsman regarding their behaviour

If they keep 'phoning you tell B.T to change your number or put the 'phone down as soon as you know it's them.
The problem is if you own your own house and have equity in it they can auction it for the debt.
My debts stretch back three years and I owe over £200,000

tell these horrible people that you have informed your lawyer about all the pest calls. if they continue to phone, dont say anything, hang up, until all thelegal stuff gets through. hope you get this sorted. good luck
