my fiance purchased a home in georgia that we were to move to...she "gifted" me the deed...i moved near the home...which we rented out until she would be able to move there...i maintained the home and spent thousands of dollars on repairs and maintenance...we broke up and she wants me to release the deed

take her to court and make her pay you all the money for the repairs then give her the deed back****

And you will likely wish to do that... fair is fair.....Both of you need to see an attorney --- the same attorney!!! (A mediating attorney) Don't get into an adversarial position of each of you getting one.... they each will end up with about $6000, and you each will have nothing... Every state is different. If I am correct you wish to have returned to you the amount of money you invested in repairs, right? And if you are going to try to take her house away from her, gift or no gift, you'll likely loose it all. The deed was "gifted" to you under the assumed condition that the two of you would live in the house. That isn't going to happen now..... so if you don't get greedy, you should be able to regain your repair money. Again, hon, use a mediating attorney, and have proof with receipts of the amount of money you invested....

you need to consult an attorney because different areas are different. While on one hand you spend that money for repairs and maintanance, how much of that did you get from the rent money? You may be able to take out a mortgage for the amount you lost in the deal or put a lien on the house but you need to consult an attorney to figure all that out.

Consult a lawyer. If it was a true gift then perhaps not. A lawyer can advise you on that. But, morally you have an obligation to do the right thing, and so does she. Turn it into a win-win situation for both of you.

You have few rights if you aren't married. Is the deed in yor name now? If so, you have a good case. Contact an attorney.

First check with the local tax assessor office to see if your name is actually listed there as co owner. If so, I would not sign until she paid you back.

money back before signing it back to her.
