We are currently living overseas and plan to move back to the US in 2 months. We have a baby and a house in the US. It's a difficult step to take and I want to plan correctly so I am not taken advantage of by my husband and not left out in the cold.

Use a mediating attorney --- look under attorney, divorce-- mediating. You both use the same attorney, and you both pretty much agree on how your estate will be split before you even see the guy.... the attorney fills out the blanks, keeps the both of you from making major errors, files and your decree is granted usually in 6 months, depending upon the state in which you file. Do not under any circumstances get into an adversarial position where you each get an attorney and have at it.... it will cost you each $6000, and it is in their best interest to drag it out..... they end up with your money, and neither of you has anything

Well, many states do not offer the option of a no-fault divorce - this means that one person must have done something wrong, like adultery. Usually, if no one is at fault, then the court requires a legal separation but it depends on the state in which you plan on filing.

If you have a baby and a house, and you plan on asking him to move out and get custody of the baby while the divorce is pending, then it's probably a good idea to get a separation agreement to lay out some ground rules.

When you return to the states, find a good divorce attny. In the meantime make a plan to meet your goals. To finalize a divorce usually takes time. Thus, I wouldnt file for a legal separation, to further prolong your emotional pain.

ANYONE can afford a lawyer. The County Bar will find you one you can afford.
