For those in this post that believe it is illegal to give a bad reference to someone, please be advised, it is not against the law to do so. What is against the law is to give false information, or facts that are not true. They can give out information about you that is truthful (bad attendence, fired for cause, not rehireable). Most employers will only give out dates of employment, job title and confirm salary. If you are concerned what will be said about you then have someone call up your former place of employment as a prospective employer and do a reference check on you as a prospective employer. Most companies will only allow their H.R. department do the verifications, so list the H.R. department rep. and ask that they contact them directly.

Did you report the bullying / Harassment? They can not give you a bad reference only decline from giving you a reference. However if you reported this bullying and nothing was done forcing you out of a job, you may have some leverage to get a reference by letting them know a) that you need one and b) if they don't give you one you will be left with no option other than to claim for "Constructive dismissal" and take them to a tribunal, chances are they will give you a reference just to avoid the hassle of it!

I sympathise as I was in a similar position once. All this stuff about them being obliged to give a reference - I didn't trust them so I wrote the job out of my CV and said I was freelancing for that period. It all depends on how long this job lasted for, in other words, how long a period have you got to account for, and is freelancing appropriate for your kind of work. This sort of thing can really dent your confidence and I wish you the very best of luck.

Is there a co-worker or someone you supervised there that you got along with well? You could try to use them as a reference. If not, can you only use people as references from other jobs? I did not get along with my supervisor, and I don't use her as a reference.

Easily.

A company is legally obliged to provide a reference that is non-discriminatory. Your old company are not allowed to comment negatively on things that could be subjective. They can comment on factual elements such as technical competence, punctuality, timliness and sickness, etc.

The law was changed not too long ago to protect employees from being taken advantage of in this way.

It's illegal for a company to refuse you references and they are not allowed to give bad or negative comments in the reference either.

Also I would think about industrial tribunals if what you say is true and screw them for some bucks first. Then ask for a reference.

was there anyone above you that wasn't the person that harassed you if so ask them if not you can still ask for a reference as they are unable by law to give you a bad one

go to your local jobcentre. they'll help you as you've been unfaired dismissed. its called unfair dismissal and it can all get sorted through a phone call from jobcentre.

you should just ask for a reference as its your right. you shouldnt be scared to ask and tell them that you're going to be in touch via a team of workers from jobcentre to **** him up.

Give a mate's name & home address .Say they wored at the company .Easy. No one ever checks these things.

your old firm have to give you an honest reference or you could have them for deformation of character good luck
