Depends on a couple of things, first...the boundaries of the land (ie - survey), second...the local laws regarding private property, third....whomever constructed the fence

Let me guess ... your neighbor had a fence on his property that served as a backdrop or boundary to your garden and it was destroyed by a storm. You are concerned that either he won't rebuild it at all, or will rebuild it in a manner that doesn't suit you. Perhaps you are the one who owns the fence, and your neighbor wants you to fix or replace it for similar reasons.

In either case, the general rule is that the fence belongs to the person who owns the property upon which it rests. The owner can do anything he wants to the fence as long as it complies with local zoning or building ordinances governing fencing.

Since you do not provide a general location, it is impossible to advise to as to what your local laws might be. Best advice is to visit your local planning/zoning or building office to get the rules that apply to your area.
