I say it is legal for home viewing. What do u think?

Only if you're going to sell your copy...........You can copy for your own use only....

It's perfectly legal. That was established years ago. However if you record a show then charge people admission to come watch it, or you make copies and sell it, that would be illegal.

To my best of knowledge, it is perfectly legal to tape a program or game for purposes of viewing at home... as long as there is no money-making enterprise involved or an entry fee to view (like in a bar).

It isn't illegal as long as you aren't selling copies. If it's for home use, by all means record away!

If he is selling any copyrighted material for which he does not own the rights (or have authorisation from the owner), he is committing a crime. It sounds to me as if he is violating copyright law from your description. But the material may be in the public domain, in which case anyone can sell it. Or he may actually own the rights (doubtful). File a complaint with ebay and try to get a refund.

No it is not. You can record for private viewing, but not for distribution or sale.
